Bristol based Barrister David Cotterell has lied to both me and my mother for personal gain
David Cotterell (a Bristol based barrister) made a promise to both myself and my mother. He would pay me half the value of the house as part of a long standing arrangement, if he was left the property by my mother.
This was in June 2014, but soon after, he contacted a solicitor. Within weeks the property was left to him and a new will had been signed making him sole executor. Two weeks later my mother was dead.
Furthermore, not acting in the best interests of the beneficiaries, he has attempted to keep £70,000 deposited in her bank accounts, despite her willing it to my sister and myself. Having issued proceedings against him he has now backed down, but still refuses to honour his promise to pay half the house value.
David even failed to call me to tell me my mother was dying. When I called the hospital in the morning she had died. I feel I have a morally bankrupt barrister brother who has a blatant disregard for truth and honesty. He has lied to both me and my mother and has gained a house worth around £1,000,000 with little consequence for his actions.

My mother died in September 2014, aged 89, only weeks after David Cotterell had finished taking her to the solicitor multiple times.
Her original will (leaving us both as executors and equal share) was now redundant. Mother signed a new will only weeks before her death. David now owns her house entirely and is sole executor and in complete control.
This site contains clear evidence that all the above is true although I suspect David will not want this in the public domain. Despite lying, distorting the truth, withholding information for personal gain and heavily influencing my mother, David Cotterell maintains he has done no wrong. I disagree and for me the truth is important and I would warn people this goes on more than you might think.
This is my attempt at some sort of understanding process and closure on what has been a very difficult journey since the passing of my mother. I also hope others might learn from it and perhaps consider how unfair Undue Influence law can be – perhaps it’s time for a change in the law?
